Real estate law typically involves the purchase, sale, re-finance or leasing of residential or commercial property.

RESIDENTIAL REAL ESTATE

PURCHASES AND SALES

Properties for purchase or sale may be new home construction, new condo construction, or existing properties, such as single family dwellings, townhomes, multiple unit properties, condominiums, cottage/recreational properties, etc. Properties may be purchased for personal use (to be used as one’s residence) or investment purposes (to be leased).

RE-SALE HOMES

When dealing with re-sale properties we are able to assist both buyers and sellers who choose to represent themselves through services such as Grapevine or choose to work with licensed real estate agents. When an agent is involved in the transaction, the agent will typically draft the Offer to Purchase and make all the necessary amendments that occur as a result of negotiations. Our clients may request that we review the Agreement to ensure that specific clauses are included or deleted in order to protect their best interests.

When our clients choose to work without an agent, we will usually draft the Agreement of Purchase and Sale for our buyer clients based on the terms agreed upon by all the parties.

If you are the Seller, we will review the Agreement prepared by the Buyer's lawyer to ensure it meets your needs.

NEW HOMES

When buying from a builder, dealing with an Agreement drafted by the builder's lawyer, we will review the document in detail with you to ensure you are aware of and understand your various rights and obligations - and those of the builder.

MULTI-UNIT PROPERTIES

When purchasing a multiple unit property, there are issues of fire retrofit and electrical safety, which we will assist you with. This involves making enquiries with the Fire Services Department and the Electrical Safety Authority to determine whether or not the property complies with their requirements. Compliance will be required for mortgage/financing purposes and insurance purposes.

CONDOS

When purchasing a condominium unit, the agreement of purchase and sale will usually include a condition for the review of the "Status Certificate Package". This package consists of a Status Certificate, copy of the condominium's most recent budgets, copy of the Declaration and By-Laws, copy of the most recent Reserve Fund Study and the Rules and Regulations of the condominium. We will review these documents to ensure that the condominium's finances are in order and that there are no unexpected pending costs, such as a special assessments or factors leading to a substantial increase in condo fees. We will then discuss all of this information with you in detail, including what your insurance and repair obligations are with respect to the condominium unit.

COTTAGES & RECREATIONAL PROPERTIES

When purchasing a cottage/recreational property, in addition to the review of Agreement of Purchase and Sale, there are numerous issues to be examined. Typically, these types of property are on well and septic systems. We will assist you to ensure that they are both in compliance with municipal requirements and in good working order. Once again, this is often required for mortgage/financing purposes and insurance purposes. Depending on the property's location, there can also be access and waterfront issues. We will investigate these on your behalf.

RE-FINANCE TRANSACTIONS

Re-finance or mortgage transactions can be coupled with a purchase or on their own. Some examples of when one might wish to re-finance are: for the purpose of consolidating debts, for funding a renovation project, for funding a business venture, for investment purposes, etc. We will assist you in dealing with the lending institution to make required searches, to prepare the mortgage documents and to attend to the registration of those documents. We will also ensure that any prior mortgages, debts, etc. get paid from the finance proceeds.

TITLE TRANSFERS

Real estate law can also include the preparation and registration of Title Transfers, which are often used to change, add or remove a person from title. This can be required for numerous reasons, such as a change in one's spousal status, the death of a co-owner, a change in an investment partner, estate planning purposes, etc. We will prepare and register the necessary documents on your behalf.

COMMERCIAL REAL ESTATE

Our team is experienced with commercial conveyancing, financing and development work. From offer to closing and everything in between, we will assist with the negotiation of the transaction, the development and drafting of the agreement, and all closing and registration arrangements.

Our corporate team works side by side with our real estate team to ensure that all corporate needs specific to each individual transaction are met.

COMMERCIAL LEASES
